Seller agrees that this puppy or dog is in good health to the best of my knowledge at this time. Puppy has been checked by my vet buyer will be given shot and worming records.
Buyer MUST take this puppy or dog to the vet within 72 hours after leaving my premises or this contract will be void. If any life threatening health defects are found, Seller much be notified within 24 hours with a full statement from the vet as to the health defect. Shipping and veterinary costs are sole responsibility of buyer. If your Vet finds the puppy to be unhealthy for any reason, a FULL written report by your Licensed Veterinarian must be sent to Breeder to rectify your situation within 24 hours of your Vet’s exam. If the Report is received by Breeder, and deemed by our Vet to be accurate, Buyer will have the option for a replacement puppy with one of equal value (when one becomes available), only if it has been determined to have a genetic defect that will cause death to the puppy. Not covered are allergies, thyroid dysfunction, or any other autoimmune disorders that may be caused by environmental factors. The guarantee does not cover any skin or eye problems. Also not covered are parasites, internal or external, (puppy has been on a regular worming schedule and information given to buyer), or parvo virus. NO REFUNDS WILL BE GIVEN AT ANY TIME.
ADDITIONAL PROVISIONS AND TERMS OF SALE:
A)Buyer agrees to provide for this dog’s emotional and physical care, including annual physical examinations and recommended vaccinations by a licensed veterinarian; nutritious food, etc.
B)Seller recommends neutering (males) and spaying (females) at age of six months. Altered dogs typically live a healthier life and generally have fewer behavioral problems.
C) Buyer agrees to inform the seller if the buyer intends to sale or transfer ownership to a third party. FIRST OPTION to resume full ownership must be given to seller at a price / (FOR NO MORE than original purchase price.) This would take into consideration the costs incurred by the breeder in caring for the dog and locating a new home. The dog will be returned with the registration papers and any medical records. The seller has ten (10) days to accept or reject this right of first-offer. If this dog should, anytime in its lifetime, need to be surrendered at no cost, the buyer will reclaim this dog, and its disposition becomes the choice of the breeder/seller. Under no circumstances is the dog to be placed in a pet shop, animal shelter, rescue or similar establishment. IF IN THE EVENT THE BUYER SELLS said dog/puppy- A fee of $3000 will be collected if the dog is sold or rehomed without the seller's knowledge and consent (Limit the puppy Flipping)
D) Should the buyer be unable or unwilling to fulfill any of the above provisions, or if this dog is seized by any local authority as having been neglected or abandoned, the seller retains the right to reclaim this dog without compensation. The buyer agrees to pay the seller any and all expenses, including court costs and reasonable attorney fees, in enforcing the terms and provisions of this contract. Canines are livestock and therefore cannot be returned for any reason other than those stipulated in the Health agreement or additional terms and provisions sections of this contract. All sales are final.
E) Breeding Prerequisites: Breeding of a bitch shall be every other heat cycle or no more than 1 (one) back to back cycle with a 1(one) year rest period before again breeding and ONLY after the age of 2 (two) years, and ONLY after the bitch has been OFA certified and ONLY to an OFA certified stud dog.
F) Buyer agrees upon purchase of the puppy that the Dog will be registered with the name: ________________________________ followed by the name of Seller's Kennel Name - von Hocking Hügel Hirt .
G) Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction of the State of Ohio, the Hocking County . It is agreed the place of venue for all legal disputes shall be in Hocking County, Ohio. This sale is subject of laws and regulations of State of Ohio only.
H)Buyer agrees to provide Seller with Photographs suitable for advertising and photocopies of all awards and critiques along with the judge(s) name(s) and the Club sponsoring the show. Buyer also agrees that Seller may use the photographs and any particulars of qualifying awards in any future advertising. Pictures are to be sent at 6mos, 12mos, 18mos, and 24mos.
I) Buyer agrees Seller will REPOSSESS DOG OR BITCH UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the seller INCLUDING BUT NOT LIMITED TO court cost, Legal Fees.
J) Buyer agrees that this dog or bitch is NOT to be LEFT IN A BACKYARD OR KENNEL ONLY/CHAIN, This dog or bitch is sold with the understanding that it was to go to carefully selected parties and that Buyer STATES the dog or bitch would become a member of the family. (This is to assure proper development and maintenance of the temperament for which the animal was bred.)
DEPOSIT (Surety of Action Deposit) in the amount of $__________ is required to hold this Puppy for the Buyer until date of Delivery.
There are no refunds on Deposits, unless otherwise agreed here in writing. Failure of the Buyer to complete this purchase would subject Seller to lost opportunities to sell the Puppy to some other Buyer and retention of the Deposit is meant to compensate Seller for his possible loss. This deposit signifies the intent on the part of the Buyer to follow through with the Purchase of this Puppy. The Seller reserves the right to void this transaction and refund the Deposit if we learn of any reason why Buyer might not be suitable for the puppy –( i.e. Buyer is found to be an animal abuser, violent person, representative of a Pet Store, representative of a pharmaceutical research laboratory etc.)
Puppy will be sold on an AKC Limited registration.
We offer a guarantee up until your dog / bitch reaches the age of 26 months provided there are no breeches in your contractual agreements written herein.
HIP GUARANTEE-
X-ray films of the pups hips / elbows, showing proper positioning, and meeting OFA standards, must be submitted for evaluation to OFA,Penn Hip, SV at the owner’s expense, at 24 months of age . The said dog / bitch will be free of genetic origin hip dysplasia at the age of 26 months. If in OFA's evaluation, the pup shows
evidence of mild hip dysplasia or worse at the age of 24 months of age Buyer has this option..
1) Keep the dog, and put 1/3 of original purchase price to a new pup of a like quality if available. Buyer is responsible for remainder of monies owed on new pup. Breeder requires proof of spay or neuter of the dysplastic pup before honoring guarantee.
2) Keep the dog, and receive 1/3 of the original purchase price back if a replacement pup is not wanted. Breeder required proof of spay or neuter before honoring guarantee.
3) Return said dog to Seller and get a replacement puppy of equal value (when one becomes available).
This contract applies to the original puppy only and is non-transferable to a second party. No replacement puppy and or money will be given if the male or female has been bred. Buyer is responsible for transportation costs to and from Hocking Hügel Hirt- Hocking Hills Shepherd on original and replacement puppy.
By signing this agreement, the buyer acknowledges they have been informed young bones do not properly calcify until 12 months of age. Buyer acknowledges we will guarantee the hips until 26 months of age, providing the buyer agrees they will not allow environmental conditions to adversely affect the development of the hip structure. The buyer is aware if they allow the dog to engage in activities that would stress the hips before the age of 12 months the hip guarantee becomes null and void. Activities include, but not exclusively, repetitive jumping, stair climbing or any activity that may cause injury.
This contract contains the entire agreement between the parties and no statement or verbal agreements made by either party that are not contained in this written contract shall be valid or binding. This contract may not be modified or altered except in writing and signed by both parties. Violations of this contract will constitute BREACH OF CONTRACT.
I have read and understand the stipulations of the contract and voluntarily agree to all elements, stipulations and provisions herein.
